TERMS OF USE (Handelsbetingelser længere nede)

These conditions apply to consumers when shopping on Pompette ApS's webshop: pompette.dk.

Note: In order to purchase goods via Pompette ApS you must:

  • be at least 18 years of age or have such a higher age as may be required for the purchase of beer, wine and spirits in the country in which you reside
  • have accepted these terms of trade,
  • provide us with your name and address (including valid delivery address), phone number, email address, payment details and other mandatory information, and
  • be the owner or authorized holder of a valid payment / credit card for the purchase of the goods.

You will need to create a personal user account. You are solely responsible for keeping your username and password confidential and for restricting access to your username, password and account, and you agree to assume responsibility for all activities and purchases made on your account unless such activities or purchases is performed by an outside third party who has accessed your account in a manner that is not due to negligence or negligence on your part.

Delivery of orders through our website is not a legally binding agreement. Once you have placed an order through our website, our system will automatically send you an email stating which goods you have ordered. There is only an electronic receipt for receiving your order.
You should be aware that the automatic reply (via email) is not a legally binding order confirmation, whereby an agreement has been entered into. Pompette ApS thus has the opportunity to cancel your order due to printing errors, sold out products, technical problems, delivery failures and similar situations.
Binding order confirmation / invoice is first sent to you once we have shipped the goods that you have ordered. You will also receive an e-mail with associated Track & Trace information where applicable.

All our prices are inclusive Danish VAT and taxes, but excluding customs and shipping costs.
For all other orders, you must pay all costs for shipping the ordered goods and customs where they apply. The shipping costs are added to the price stated on Pompette webshop's product pages and will appear immediately before you place your final order. The customs costs are determined by the recipients customs agents, should it be subject to that. Pompette ApS can therefore not liable for eventual customs charges. 
We take reservations for printing and proofing errors as well as tax and price changes.

In general
Payment for items can be made online using Visa, Mastercard, Diners Club card, JCB card and American Express. 
The card information is transmitted SSL-encrypted between customer and Pompette's Payment Provider. We use the ePay payment system, which is certified according to the PCI standard (see more at www.epay.dk). However, personal information (name, address, etc.) is not encrypted.
The amount will only be charged on your card once your order has been confirmed and the goods ordered are shipped.

We use different suppliers depending on the content of the order and depending on which warehouse the goods are shipped from.
Expected delivery time is between 1-2 weeks from your order. When the item is shipped from our warehouse, you will receive an email as a receipt for shipping and Track & Trace information where applicable.
Delivery is deemed to have occurred when the goods are in your possession. All deliveries must be acknowledged upon receipt. 

Recipient is also responsible for the proper forms and legal documents ensuring they can receive said products. We are not liable for any errors that may occur due to local laws

14 days deadline
You have the right to withdraw from this agreement without justification within 14 days.
The right of cancellation expires 14 days after the day on which you or a third party stated by you (but not the carrier)
when the goods in physical possession.
when the last item in physical possession if it is an agreement on several different goods ordered in one order and delivered individually.
the last lot or the last part in physical possession, if it is an agreement for the supply of a product consisting of several lots or parts.
the first item in physical possession if it is a contract for the regular delivery of goods over a certain period.
The right of withdrawal expires 14 days after the date on which the agreement with Pompette ApS is concluded.

Exploitation of the right of withdrawal
In order to exercise the right of withdrawal, you must notify us of your decision to cancel this agreement in an unambiguous statement or by using this standard withdrawal form sent by the withdrawal deadline. post-delivered letter or email to:

If you exercise your right of withdrawal, we will refund all payments received from you, including delivery costs (excluding additional costs due to your own choice of delivery form other than the cheapest form of standard delivery we offer), without undue delay and in any case no later than 14 days from the date on which we received notice of your decision to cancel the agreement. We will make such a refund with the same payment method you used in the original transaction unless you have explicitly agreed otherwise.
We may withhold the refund until we have returned the goods, or you have provided proof of having returned the goods, whichever is earlier.

without undue delay and no later than 14 days from the date you informed us of the exercise of your right of cancellation. The deadline is met if you return the goods before the expiry of the 14 days.
Please enclose a copy of the order confirmation with the returned goods.
You bear the risk of the goods from the time of delivery of the goods to you and shall be liable for any deterioration in the value of the goods resulting from handling other than that necessary to determine the nature, characteristics and manner of the goods.
Upon return, you are responsible for ensuring that the goods are packed properly. Certain goods, by their very nature, cannot be returned by normal mail. This applies to bottles and other contents that require proper packaging.
You must pay the direct costs of returning the goods. We do not accept packages sent by COD.
The cost of return is expected to amount to a maximum of approx. DKK 300, but in special cases may be higher, eg. for particularly large return shipments and for shipments from certain foreign countries.

You have two years of warranty right after the Danish Buying Act. However, for products with a limited lifetime, your warranty is limited to the shelf life that is customary for the product concerned.
If you discover an error or defect in a purchased item, you as a consumer must as soon as possible and within a reasonable time inform Pompette  ApS and explain where the error or defect exists. If you advertise within two months after the defect is discovered, the complaint will always be timely.

If the complaint is justified, we will refund your (reasonable) freight costs. The product must always be sent back in proper packaging, and remember to get a receipt for shipment so that we can refund your shipping costs.

A complaint about a product or service purchased from us can be submitted to the Danish Competition and Consumer Agency's Center for Complaints, Carl Jacobsens Vej 35, 2500 Valby. You can appeal to the Center for Complaints Solution via www.forbrug.dk.
The EU Commission's online complaint portal can also be used for filing a complaint. This is particularly relevant if you are a consumer resident in another EU country. Complaint is submitted here: http://ec.europa.eu/odr
When submitting a complaint, you must provide our e-mail address jaisoif@vinsupernaturel.dk.

In order for you to enter into an agreement with us, we need the following personal data: Name, address, telephone number and e-mail address. We will record your personal information for the purpose of providing the product to you and (if you have given your consent) to inform you of products, programs, services and promotions that we believe may be of interest to you. The registered information can be found on our website under "My Account".
When collecting personal data via pompette.dk, we ensure that it always happens by submitting your explicit consent so that you are informed about what information is collected and why.
As registered with pompette.dk, you always have the right to object to the registration. You also have the right to know what information is registered about you. You have these rights under the Personal Data Act and inquiries related thereto are directed to jaisoif@pompette.dk.
Your information is not disclosed or sold to a third party, however, your email address is disclosed to the carrier in connection with the sending of mail packages (so that you can receive delivery information, including T&T).
Personal information is registered with Pompette ApS and stored for five years, after which the information is deleted. Customer information is stored and transmitted unencrypted. Payment data is, of course, transmitted encrypted, see point 5 (Payment) and is only used for carrying out your payment for purchased goods.

11. LAW
These trading terms and your purchase of goods from pompette.dk are covered by and must be interpreted in accordance with Danish law.
Any disputes or claims that may arise in connection with these trading terms or your purchase of goods from pompette.dk (including disputes or claims outside of contract) will have to be settled by the Danish courts as the venue. This does not affect any legal right that you as a consumer may have to file a case with your local jurisdiction.
